न्यायालय ने 69,000 सहायक शिक्षकों के लिए
नई चयन सूची बनाने का निर्देश दिए हैं। वर्तमान में कार्यरत शिक्षकों की नौकरी चली
जाएंगी। लेकिन न्यायालय ने इसमें एक बड़ी राहत भी दी है।

अध्यापक सरकारी नौकरी भर्ती में
आरक्षण के प्रावधानों में अनियमतता से जुड़ा है। याचिकाकर्ताओं ने एकल पीठ के 13 मार्च, 2022 के आदेश को चुनौती देते हुए कहा था कि
राज्य सरकार द्वारा दी गई आरक्षण व्यवस्था सही नहीं है। जिसके बाद अब हाई कोर्ट ने
पुरानी मेरिट रद्द करने के आदेश दिए हैं। जाहिर है कि इससे वर्तमान में कार्यरत
शिक्षकों की नौकरी जाएगी। लेकिन अपने फैसले में कोर्ट ने एक बड़ी राहत भी दी है।
तीन महीने में जारी होगी नई मेरिट लिस्ट!
अदालत
ने स्पष्ट किया है कि आरक्षित वर्ग के वे अभ्यर्थी जो सामान्य वर्ग की मेरिट सूची
में आते हैं, उन्हें सामान्य वर्ग में समायोजित
किया जाना चाहिए। साथ ही ऊर्ध्वाधर आरक्षण का लाभ क्षैतिज आरक्षण श्रेणियों को भी
दिया जाना चाहिए। इसके अलावा हाई कोर्ट ने एकल पीठ के उस फैसले को बरकरार रखा
जिसमें 5 जनवरी, 2022 को आरक्षित वर्ग
के 6,800 उम्मीदवारों की चयन सूची रद्द कर दी गई थी। पीठ ने
राज्य सरकार और अन्य संबंधित अधिकारियों को निर्देश दिया कि वे तीन महीने के भीतर
नई चयन सूची जारी करने की प्रक्रिया पूरी करें।
न्यायालय ने कहा है कि “टीईटी” में आरक्षण का लाभ उठाने वाले उम्मीदवारों को अनारक्षित वर्ग में नहीं रखा
जा सकता। भले ही वे सामान्य वर्ग के लिए निर्धारित न्यूनतम अंकों को प्राप्त करते
हों। इसके अलावा उच्च न्यायालय ने अपने आदेश में शिक्षकों को राहत देते हुए यह भी
स्पष्ट कहा कि नई चयन सूची बनाते समय यदि वर्तमान में कार्यरत किसी भी सहायक
शिक्षक पर विपरीत असर पड़ता है, तो उन्हें मौजूदा सत्र का
लाभ दिया जाए ताकि छात्रों की पढ़ाई बाधित न हो।

A/B/C/D after the Chief Minister ordered for the completion of recruitment
process by May 15, 2020. The order came after the Allahabad High Court fixed
the qualifying cut off marks at 60-65% under this recruitment drive for this
recruitment. Total General Category candidates who are able to score 65% and
above marks and SC/ST/OBC /EWS category candidates who secured 60% and above
